Domestic Partnership Registry City Clerk - Home | Departments

In May, the Topeka City Council adopted City of Topeka Ordinance No. 19905, establishing a Domestic Partner Registry (DPR). For more information, see Ordinance No. 19905.

Who can register?
The two partners must meet the following criteria:

  • Both partners must be residents of the City of Topeka, Kansas
  • Both partners must share a common permanent residence
  • Both partners must agree to be in a relationship of mutual interdependence
  • Neither partner can be currently married to a third individual or a member of a domestic partnership with a third individual
  • Both partners must be at least eighteen (18) years old and competent to contract
  • The partners may not be related by blood as defined by Kansas law
  • Both partners must agree to file a Declaration of Domestic Partnership with the City of Topeka

Applicants should understand that registration creates no legal rights
No person shall register or attempt to register a domestic partnership without the consent of the persons to be registered, and any person who is convicted of violating this section of the City Code shall be guilty of a misdemeanor.

No individual who has previously filed a Declaration of Domestic Partnership in this City may file a new Declaration of Domestic Partnership until at least 90 days after the date that a Request for Removal from the Domestic Partnership was filed (this prohibition does not apply if the previous domestic partnership ended due to death of a partner).

The information provided on this Declaration of Domestic Partnership and any other records associated with the application are public record and may be viewed in accordance with the Kansas Open Records Act (KORA).
